Do I need a lead inspection when buying a home in Rhode Island?

Lead paint is a major consideration when buying in Rhode Island, because so much of our housing stock predates 1978, the year lead-based paint was banned for residential use. You are not strictly required to perform a lead inspection just to buy a home for yourself, but you have the right to test, and there are important rules and reasons you should understand before you decide.

First, disclosure. Federal law requires sellers of homes built before 1978 to disclose known lead hazards and give you a lead pamphlet, and it entitles you to a 10-day period to conduct a lead inspection or risk assessment at your own expense. A lead inspection identifies where lead paint is present, while a risk assessment focuses on where it poses an active hazard, such as peeling paint or friction surfaces.

Where it gets specific to Rhode Island is if you plan to rent the property out or if children will live there. RI has its own lead laws for rental housing, and landlords generally must meet lead-safe requirements and obtain a Certificate of Lead Conformance or a comparable lead-safe certificate for pre-1978 rentals. So if you are buying a multi-family or an investment property, lead compliance is not optional, it is a cost and a legal obligation you need to budget for. Massachusetts has its own stricter lead law as well, which can require full deleading when a child under six resides in the home.

Dealing with lead ranges from inexpensive interim controls, like stabilizing and repainting surfaces, to full abatement that can run into the thousands or more, depending on the scope. Because intact, well-maintained paint is lower risk than peeling or chipping paint, the condition matters as much as the presence.
